Payment Terms
To book the villa we require a 50% deposit and the balance is due 4 weeks before arrival.
The booking shall become effective only when the amount of the deposit has been received. Quoted rates are not guaranteed until receipt of the deposit. If funds are not received within 5 banking days following the date of the booking, the booking shall be deemed to be cancelled. Funds should be transferred into the bank account detailed separately.
Final payment consisting of the remaining balance must be received at least one month prior to guest arrival (100% advance payment will be required if the booking is made less than 30 days before the guest’s arrival). Failure to make the final payment on a timely basis will make reservations subject to automatic cancellation. All rates for accommodation are quoted in US dollars.
The Security Deposit is 1500 USD. This can be paid on arrival in cash and will be returned to you before departure once the villa has been checked.
Payment can be made by Bank Transfer to our Thai or Jersey US or Sterling Accounts, or by Paypal (5% Paypal Charge).
Terms & Conditions of Booking
Please Note: Payment of the booking deposit constitutes acceptance of these Terms.
The Booking Terms and Conditions of the holiday letting as agreed to by both parties are as follows and departure from same by you permits the owner or agent to refuse the key, amend the charge or immediately terminate the occupancy.
Inclusions – Villa Oriole representative to meet guests at the airport in Phuket and transportation to the property, check in by Villa Manager including inventory check, rental of the Property and its gardens, utilities (unless otherwise indicated), gardener, housekeeper (8.30 am to 5 pm daily), bedlinen, towels and pool towels, welcome pack, toiletry starter pack per bathroom, information pack and all local taxes, return transportation to the airport. Villa Manager available in case of emergencies.
Exclusions – Rates do not include baggage handling, gratuities, international telephone, baby sitting, food supply, soft drinks and/or liquor, personal items and expenses, nanny and driver, excess baggage charges, Passports or Visas, sightseeing or tours, tips, any excessive cleaning required upon departure (such as upholstery or curtain shampooing, etc) nor replacement of breakages/damages in furniture, decoration and villa finishes and anything not included in the inclusions list.
Extra Services – We are happy to arrange sightseeing, activities and tours, cooks, drivers and nannies. It is recommended that extra services are booked at least 8 weeks before travel.
Rates – Booking rates quoted are on a per night basis and are inclusive of daily maid service. Driver and cook are additional. The rate is determined by the Owner at their sole discretion and can vary according to the duration of the booking and of the season.
Registered Guests - The number of people staying at the property must not exceed the maximum capacity indicated in the booking form, except in the case of infants (under four years old), or unless specifically authorised. Should the Owner or the Villa Manager find out that the number of people staying at the Villa exceeds that on the booking form, additional guests will be charged for at 50 USD per person, per night, or asked to vacate and in case of non compliance the Booking may be cancelled without any other notice without any refund. The Owner or the Villa Manager, by the Rules, shall be entitled to take all legal measures to make the above enforceable under Thai Law.
Safety – Please take the time to familiarize your party with the property and take note of escape routes in case of fire. Every property will have hazards such as open stairs, open drops etc and as such your party should take responsibility for their safety. Please take every precaution against theft and burglary, any valuables left at the property are left at your own risk. The property owner is not responsible for any loss or damage. Please take extreme care and caution when using the swimming pool, check depths and how to get out of the pool. Non swimmers and children are your responsibility at all times.
Valuables – Oriole Villa is fitted with individual safety boxes. Any valuables left at the villa are left at one’s own risk. The Owner or staff are not responsible for any loss or damage. It is advised that valuables are locked away and doors and windows are locked when leaving the villa.
Arrival & Departure Times – Unless otherwise agreed we request arrival at the property from 3pm and departure at 12pm. We are very flexible on this due to the flight timings for Phuket and we appreciate you may have travelled for many hours to get here. Please note that there maybe an additional charge for very early arrival or very late departures. If your arrival is delayed please notify us as soon as possible. If we have not received notification of delay at least 80 minutes before arrival then there will be a charge for the minivan.
Linen & Towels – Linen and towels are included. These are normally changed every three (3) days. The villa is fitted with washing and drying machines for use by guests, or a laundry service can be provided by the villa staff at extra cost.
Telephones & Internet – An internet service is provided but please note in Phuket this service is erratic and we cannot be held responsible for the loss or consequences of loss of service. We will endeavour to remedy the problem as soon as possible
Vehicle or Motorbike Rental – We can arrange vehicle rental through a local company if required. It is also possible to rent through such companies as Avis or Hertz who have desks at the airport. With regard to motorbike rentals we advise against this but if you wish to do so please make sure helmets are worn at all times and be extremely careful, this is one of the most dangerous places to drive!
Infants – We provide a cot & highchair free of charge. If you require further facilities please advise us as soon as possible.
Pets & Wildlife – Pets are not allowed in the villa. Please do not leave food out and keep doors and windows closed when possible. We would appreciate it if you would not feed any stray animals that may find their way into the grounds as future guests may not find them welcome. We cannot be held responsible for the presence of insects, reptiles or animals at the villa.
Complaints – The Villa Manager’s duty is to make its best efforts to fix in the shortest time any technical problems which may arise during the booking period. The manager must be notified within 24 hours of the occurrence giving rise to the complaint. If the villa is vacated by the guest due to above and before the end of the booking period an appropriate refund will be returned to the guests at the Villa Manager’s discretion.
Conduct & Behaviour – If a booking is not made by the guest directly but by his agent of representative, such agent or representative shall be co- responsible for the correct and appropriate behaviour of the guests staying at the villa. Should any member of the party not behave in such a manner, we may, at our absolute discretion ask the offending guest or guests to vacate the villa forthwith.
Insurance – It is a condition of the booking that the entire guest party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). The Owner is not responsible to anybody for any and all claims including any accidents related to the use of the villa. The Owner shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside their control.
Liability of the owner – The Property Manager shall keep the villa technically totally and permanently suitable for the residence of the number of persons stipulated in the Property specification. Under no circumstances shall the Owner or Villa Manager be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodations herein or as substituted. If any accommodations and/or services are substituted, the Villa Manager will act at all times in good faith and use its best efforts to substitute with accommodations and/or services of a type comparable to or better than those originally contracted. The Owner and/or Villa Manager at their sole and unfettered discretion reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or guest services.
Quotations – are subject to availability and are not guaranteed until receipt of the deposit, and confirmed in writing.
Booking Requests – are subject to availability and confirmation in writing.
Usage – the premises are let to you for holiday purposes ONLY and only for the period stated on the receipt. NO weddings, parties, or large gatherings are allowed without prior arrangement. The number of people occupying the premises must not exceed the number of people that were initially booked and/or had beds provided for unless otherwise agreed beforehand.
Payment – A holding deposit of 50% of the total rent is required to reserve a property. The balance (residual amount) is to be paid in full 30 days prior to arrival.
Currency – All prices quoted are in US dollars.
Non Payment of Residual Amount – If after a number of approaches this amount is not paid within 30 days of arrival the booking may be cancelled and the holding deposit will not be refunded.
Cancellation – If a guest requests to cancel all or part of the booking they must notify the booking agent or us directly in writing (email acceptable). The cancellation will take effect from the day the written confirmation is received. Cancellation charges will be payable depending on date of the notification of the cancellation and the period.
The following general regulations shall apply:
– More than 90 days (12 weeks) before arrival date: all deposit is refundable.
– From 45 to 89 days (4 to 11 weeks): 20% of full price will be non-refundable.
– From 30 to 44 days: 50% of the full price becomes non refundable
– From 29 days and less: 100% of the full price becomes non refundable.
The above cancellation charges also apply if we cancel the booking due to non-payment for whatsoever reason.
Refund of balances paid – Refund of monies paid for a Villa booking (and services) will be made only under the following circumstances:
If the villa becomes unfit for habitation and no equivalent replacement villa can be obtained (this qualifies for a 100% refund). The monies will be refunded back to the recipient’s account in whatever currency the deposit was paid.
Confirmed bookings – made less than 30 days prior to the arrival date must be paid in full within 48 hours following confirmation
A security deposit – a security deposit of 1500 USD shall be paid to the Villa Manager on receipt of the keys and will cover the cost of repairs, damages or breakages during the occupancy period by the guest. Subject to an inventory check by the Villa Manager the full amount will be returned when checking out or the deposit can be off set against any extra costs incurred during the stay i.e. driver, extra guests, babysitting, food etc.
Breakdowns – We accept no responsibility for any inconvenience due to machinery or appliance breakdown. The Villa Manager’s best endeavours to repair, replace or hire an alternative will be undertaken.
Descriptions – We have taken due care and responsibility to verify and check all information on our website, brochures or any written or verbal material supplied, as at the time of compilation, however, as this information is subject to change, we accept no responsibility for any inaccuracy or mis-description contained in the publications.
Unavailability – If the villa becomes unavailable for any reason we reserve the right to move the Client to alternative accommodation at our discretion. If this is not possible a full refund will be made
Non-Transferable – bookings will not be moved to alternate properties – especially due to a ‘change of mind’. Any movement of bookings is our discretion.
Change of Booking – acceptance of any changes are at our sole discretion and may be subject to additional charges.
Breakages – and losses to the villa are to be reported to the housekeeper/Villa Manager and paid for immediately.
Additional cleaning – if required will be charged to the Client at the discretion of the Villa Manager
Loss of keys or remotes – will be charged to the Client at the discretion of the Villa Manager
Pets – are not allowed on or about the premises. Any breach of this term will result in loss of your security deposit and eviction.
Smoking – is not allowed inside the property. Any breach of this term will result in loss of your damage deposit and eviction.
Hazardous materials – or any illegal or immoral activities are strictly prohibited. Any breach of this term will result in loss of your security deposit and eviction.
Fireworks - No form of fireworks, firecrackers or incendiary devices are to be used at any of our villas, nor within the grounds. Any breach of this term will result in loss of your deposit and eviction.
Any misuse – of the property due to noise complaints or property abuse will be considered a breach of contract and we reserve the right to end the rental. Illegal activities will be dealt with by the local police.
Check in/Check out – standard check in is 3.00 pm and check out is 12.00 pm. We prefer to be flexible on this so please advise at booking arrival and departure times.
Prior to booking – all prices are subject to change without notice.
No refund – will be given due to late/delayed arrival.
Included Services – Housekeeper and other services are as stated in the property details and/or Invoice.
Extra Services – any extra services available as indicated in the property details must be paid for before departure. Any charges not paid for will be deducted from the security deposit. Extra services are subject to change.
CHILDREN – Parents/guardians should be aware that due to the design and/or location of the villa there is need for constant supervision especially with regard to the swimming pools. We can advise on villa suitability before booking.
INSURANCE - It is a condition of the booking that the entire guest party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). The Owner or the Villa Manager is not responsible to anybody for any and all claims including any accidents related to the use of the villa. The Owner or Villa Manager shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of their control.
Disclaimer – The Owner or the Villa Manager do not accept liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or of any other authorities, accidents, theft to or failure of machinery or equipment or industrial action.
